Description This subject focuses on the right to privacy and examines the legal framework for information privacy protection and data governance that are established by both international and domestic law and regulation. This subject introduces students to the theoretical approaches to information privacy and data governance law and policy. In particular, the subject focuses on the European Union Directives and Regulation; the OECD Guidelines for the Protection of Privacy and Trans Border Flows of Personal data and the impact of international laws and regulation on information privacy and data governance regulation and policy in Australia. The subject explores some of the challenges in providing effective information privacy protection and data governance in cyberspace as existing laws adapt to new and advanced information technological developments and their use.

Learning Outcomes

On successful completion of this subject, students should be able to:

1. Evaluate the legal issues that arise from the use of information technologies in cyberspace;
2. Critically analyse the current international and national legal framework and policy for information privacy and data governance laws and regulation to related legal issues;
3. Effectively use critical thinking and research to resolve legal issues related to information and data governance in oral and/or written forms.
