Description This subject deals with concepts of property and the nature of property rights including the boundaries between property and other rights and the boundaries between different forms of property. The subject’s content includes the doctrine of tenure and estates, native title, and legal and equitable interests in land. Specific topics to be covered include personal property and securities, mortgages, leases, easements and profits a prendre, co-ownership, systems of statutory registration of interests in property and the principles for resolving conflicting proprietary interests (priorities).

Learning Outcomes

1. Identify legal issues relating to property and explain and analyse concepts and principles of Australian property law.
2. Apply legislation and legal principles of Australian property law to provide advice in relation to proprietary interests and disputes.
3. Explain the development of property law, including Australian Native Title law, and critically evaluate its significance in a social justice framework.
4. Demonstrate an understanding of the operation of, and assumptions that underlie Australian property law in historical, political, social, economic, cultural and ethical contexts.
5. Display clear and logical structure, using accurate citation, grammar and punctuation in written work
